DETROIT The attorney for a former Southgate police officer accused of sexually assaulting a woman in 2011 while on duty argued in Wayne County Circuit Court on Monday that the sex was consensual. The trial for Emmanuel Paravas, 44, began Monday before Judge Annette Berry. Three Southgate police officers testified, as did the woman s husband. Paravas was charged last year with third-degree criminal sexual conduct, neglect of duty and misconduct in office. He resigned from the department in March 2011. The woman, a traveling exotic dancer, told police discount car rental san diego that Paravas came to her room at the Holiday Inn Southgate, 17201 North Line Road, at about 3 a.m. Feb. 9, 2011, and raped her.
Paravas was one of the officers who had responded to a domestic violence call involving the woman and her husband earlier that night at La Quinta Inn, 12888 Reeck Road. Paravas took her to the nearby Holiday Inn to separate the couple so they could calm down. The News-Herald does not name the victims or alleged victims of sexual assaults. Her husband provided a timeline of events from that night. He said he and his wife got into a fight at the hotel while she was drunk. They argued for a while about anything and everything, he said, and she left. He said he knew she was going to go to a bar so he began looking for her because she took their car, loaded with about $30,000 of equipment. He didn t want anything to happen to her or their equipment, he said. She returned and he tracked down their car at Cecil s Bar, 22615 Goddard Road, Taylor. After going across the street from La Quinta to try to find a ride, he encountered Paravas, who said he would drive him to Cecil s. When he got back to the hotel, he and his wife argued some more, so he went to move their car so she couldn t drive it anymore. When he returned to the hotel lobby, officers were there, including Paravas. Paravas attorney, Michael Rataj, said that when Paravas entered the room, the woman was naked and seduced him. Rataj said the only thing Paravas is guilty of is biting the apple of temptation. The woman testified during a preliminary discount car rental san diego examination of the evidence against Paravas that he entered the room at about 3 a.m. She said she was in the bed, naked and under the covers. She said Paravas told her, Wise up or you re going to jail, placed what she thought was his gun on the dresser, handcuffed discount car rental san diego her and had sex with her against her will. After he and his wife were separated, her husband said, she sent him text messages and called him, but he ignored them at first. Later in the night, he began to try to contact her. When he eventually talked to her, he said, she was upset and had driven their car to Ohio. He said she told him that Paravas had raped her. He testified that when the allegation of rape came up, Paravas said she made it up and she was just trying to anger him further. In his opening statement, Rataj said that during the Michigan State Police investigation into the incident, Paravas lied and said he didn t have sex with the woman, but then changed his story and said it was consensual.
